Fine Art Photography – Terms & Conditions

By purchasing artwork, commissioning work, or using this website, you agree to the following Terms & Conditions.

1. Artistic Authorship & Copyright

All photographs created by Shipp & Co Studios (“the Artist”) are original works of fine art and are protected by United States copyright law.

The Artist retains full copyright, moral rights, and authorship of all images at all times.
The purchase of a print, digital file, or artwork does not transfer copyright or reproduction rights unless expressly stated in writing.

2. Usage Rights (Fine Art Photography)

All image usage is granted by license only.

No rights to reproduce, distribute, display publicly, or publish images are granted with the purchase of artwork unless explicitly outlined in a written licensing agreement.

Prohibited Uses Without Written Permission

Collectors, purchasers, and third parties may not:

Reproduce images in any form (print, digital, publication)
Display images online, including websites or social media
Use images for commercial, editorial, or promotional purposes
Alter, crop, recolor, or apply filters
Create derivative works
Sell, sublicense, or distribute images to others
Submit images to contests, publications, or exhibitions

Any use not expressly permitted in writing is prohibited.

3. Fine Art Prints & Editions

Fine art works may be offered as open or limited editions at the sole discretion of the Artist.
Edition sizes, numbering, paper types, print methods, and sizes are determined by the Artist.
Limited editions may vary by size or medium.
Certificates of Authenticity may accompany limited edition works.

Once an edition is closed, no additional prints will be produced in that edition or size.

4. Sales, Pricing & Payment

All prices are listed in U.S. dollars.
Full payment is required prior to production or shipment unless otherwise agreed in writing.
Prices are subject to change without notice.
Custom or commissioned fine art sales are final once production has begun.

5. Shipping, Delivery & Risk of Loss

Shipping methods and costs are communicated at purchase.

The Artist is not responsible for delays caused by carriers.
Risk of loss transfers to the purchaser upon shipment.
International buyers are responsible for customs fees, duties, and taxes.

6. Returns & Exchanges

Due to the nature of fine art, all sales are final, including limited editions and custom works.

Returns or exchanges are accepted only in the case of damage during shipping and must be reported within 48 hours of delivery, accompanied by photographic documentation.

7. Commissions & Custom Work

Commissioned works are created in the Artist’s distinct style.

Creative direction remains with the Artist.
Progress images or previews may be shared at the Artist’s discretion.
Minor revisions may be considered; extensive changes may incur additional fees.
Copyright remains with the Artist unless otherwise licensed.

8. Artist’s Right to Display & Promotion

The Artist retains the right to:

Exhibit the work in galleries or shows
Use images for portfolios, websites, social media, publications, and marketing
Reproduce images for books, catalogs, or retrospectives

Collectors may request confidentiality or privacy considerations in writing prior to purchase.

9. Image Storage & Archiving

The Artist does not guarantee permanent storage of digital files.

Collectors are encouraged to retain documentation, certificates, and receipts. Replacement files or documentation may not be available after delivery.

10. Limitation of Liability

The Artist shall not be held liable for:
Environmental or natural events
Loss or damage after delivery
Third-party handling or framing
Inability to fulfill due to circumstances beyond reasonable control

Liability is limited to the purchase price of the artwork.

11. Website Content & Intellectual Property

All images, text, and content on this website are the intellectual property of Shipp & Co Studios and may not be copied, reproduced, or used without written permission.

12. Governing Law

These Terms & Conditions are governed by the laws of the State of Montana. Any disputes shall be resolved in the appropriate courts of Montana.

13. Changes to Terms

Shipp & Co Studios reserves the right to update these Terms & Conditions at any time. Continued use of this website or purchase of artwork constitutes acceptance of any changes.
